Digital Millennium Copyright Act (DMCA) Policy

bihblog (“the Site,” “we,” “our,” “us”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), we will respond expeditiously to claims of copyright infringement committed using the bihblog website (https://bihblog.xyz/ that are reported to our designated Copyright Agent, identified in the contact information below.

Filing a DMCA Notice of Alleged Infringement (Takedown Notice)

If you are a copyright owner, or authorized to act on behalf of one, and you believe that any content made available on or through bihblog infringes your copyright, you may submit a written notification pursuant to the DMCA. To be effective, your notification must include substantially the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (including, at a minimum, the exact URL or specific location on the Site where the material may be found).
  • Information reasonably sufficient to permit us to contact you, such as your full legal name, mailing address, telephone number, and a valid email address.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please send your DMCA takedown notice to our designated Copyright Agent at the contact details listed at the bottom of this page. Upon receipt of a complete and valid notification, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged content from the Site.

Counter-Notification Procedure

If you believe that material you posted on bihblog was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification with us. To be effective under the DMCA, a counter-notification must be a written communication that includes substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled (the specific URL).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your full name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you reside outside the United States, for any judicial district in which bihblog may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of that person.

Send the counter-notification to our Copyright Agent at the email address provided below. Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the original complaining party does not file a court action against you within ten (10) business days, we may, in our discretion, restore the removed or disabled content.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, bihblog has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Important Considerations

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees. We recommend that you consult with legal counsel before filing a DMCA notice or counter-notification.

We also reserve the right to remove content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. In the event of a removal, we may notify the user responsible for posting the content so that they may submit a counter-notification as described above.
